Domestic Partnership Lawyers Serving Upstate New York
Eventually, we believe that all states will have some form of civil union for same-sex or same-gender couples. In the meantime, our lawyers can use the principles of contract law to secure most, if not all, of the same rights for same-gender couples that traditional married couples have. We may not be able to get you a marriage license, but we can help you live as if you were married.
Through reciprocal wills, domestic partnership contracts and agreements for joint ownership of real estate, our attorneys can provide a legal framework similar to marriage for domestic partners in New York. Our law office is located in the Albany suburb of Delmar in upstate New York.
Archaic Laws Expected to Change
The current law in New York that does not recognize gay marriage is archaic and we believe it will change within five to 10 years.
Constitutional amendments to ban gay marriage are similar to attempts that were made in the past by southern states to ban interracial marriage. If one reads the United States Supreme Court decisions such as Loving v. Virginia, 388 U.S. 1 (1967), the case which found it unconstitutional to ban interracial marriage, it becomes clear that the right to marry is a fundamental right and should not be denied to anyone who might possibly be a parent.
Adoption laws in all 50 states now allow same-gender couples to adopt. We think that every state will also adopt a civil union or marriage statute eventually, if for no other reason than to help keep families together.
